A heads-up on what to expect re folo today
Good morning, everybody, and Mississippi go bragh!
As I discussed yesterday, we’ve decided to wait out U.S. v. Zach Scruggs‘ plea-deadline day here at “old folo” on the gazillion WordPress servers that presumably can handle a plea, should one come, better than the server-farm that Dickie and Sid’s fried three days ago.
I’ve personally heard nothing solid one way or the other about what to expect in Oxford, so at this point I figure that, unless Zach skulks in there first thing this morning, we may see only close-of-business finally disprove the rumors (at least for today: shoot, defendants have been known to cop to it mid-trial).
Anyhow, riddenword tells me that the best time for us to transfer back to our primary site will be late-night either tonight or tomorrow night (last I heard, he and his tech hadn’t confirmed which of those works best for their schedules). But whenever it comes, we’ll handle it much as we did the first move from here to there. If you were around for that on February 10, you remember that we hushed and asked you to too for about an hour before the transfer, lest something said late get lost in the move.
We don’t know but hope that a mere flip-of-a-switch will seamlessly transfer these post-Friday folo.wordpress.com threads intact back to folo.us. If not, we’ll transfer them manually — which may take us a while, but as soon as possible, we’ll get ‘em there.
Anyhow, that’s what’s afoot technically, so carry on as usual until you see a post tonight or tomorrow night advising otherwise. As to what’s afoot legally, honey, we’s all ears . . .

Oh, I forgot to say: riddenword will be adding some kind of caching gizmo to folo.us that should dilute our Skinner-lever effect on the server-farm. If we’d had forewarning that we’d need it last Friday, maybe this could have allayed our little catastrophe. Anyhow, it should help, as will greater server-capacity . . .

Turned on NPR to hear Merkel’s voice talking of ongoing fee allocation troubles for all defendents and their repeated offenses in fee allocation with partners. This backs up a bit of specualtion some of us around here have heard about RICO civil litigation coming down the pike…

I know nothing about criminal law, so help me out, someone please:
If today’s the plea deadline, then does Zach have to go to trial should he fail to plead today?
OTOH, if he can cop a plea at any time, even mid-trial, then what is the point of the “plea deadline”?
Perhaps I am not the only person ignorant on this subject.

Just a quick thought from the road. I doubt that the government would make the deal they made with Sid without knowing a bit about what information that he had and how he would tell the story. I suspect that there may have been a proffer by Sid before the deal was made. That said, I doubt that the government would make the deal if Sid was planning to tell the tale in a way that would bring a smile to Zach’s face. If this is so then the pleas may have helped Zach a bit with the 404b evedence but perhaps puts the government in the position of having everyone there, save Dickie telling the same tale. Could make Zach’s defense more difficult. Should be interesting.

ANY news on Zach yet? Anybody seen any activity or appearances at the Courthouse? Dickie’s plea was finished by this time on Friday. Guess they must still be talking and negotiating.

The word I hear is that if Zach does plead today, it will be because his attorney brings him to the court room using a cattle prod.

Nomiss I hear that to. Apparently, from what I hear, Zach is refusing to go to the courthouse or deal. It looks like the lifetime of being taught he was above the law is going to do him in. Friday he was pacing around the square - interesting site to see.

Sorry, greenlawyer, we’ll getcha back to that very-important button ASAP. This pacing of Zach’s you saw Friday — you mean literally back-and-forth on the Square? Wowzers. Did he seem to recognize where he was, or did he look so distracted, place just didn’t matter?
Meanwhile, I’m still in no-news mode: NMC’s been in court all morning, and I don’t know whether he’s finished there yet (kinda think he probably hasn’t).

Maybe, Moore did get brought in as someone who could communicate with Zach, and who could make him understand the dire legal position he is actually in.
At least it makes you figure Moore isn’t going to be one of the names that gets traded for a sentence reduction. Either Scruggs would know if he was someone they could use for that, and I wouldn’t think they would want him representing either one of them in that case.

But, observer, wasn’t Langston first representing Scruggs (for about 24 hrs) until he (Langston) got indicted? Maybe you’re right, on your assertion, but I don’t know about the second…
